The Polish-Portuguese Chamber of Commerce and Sołtysiński Kawecki & Szlęzak are honoured to extend an invitation to you for the PPCC Members Meeting.

The meeting will address the complexities of business misconduct, focusing on various scenarios and their legal and practical implications. Particular attention will be given to the challenges encountered by company board members, including the scope of their responsibilities and the pressures inherent in their roles.

The agenda will also include an analysis of fictitious enforcement proceedings designed to harm creditors. This analysis will outline common mechanisms and their legal consequences. Furthermore, the methods employed by debtors to transfer assets prior to bankruptcy will be examined, along with strategies to mitigate the risks associated with such actions. The discussion will further cover practices leading to the marginalization of partners within companies, offering guidance on safeguarding control and protecting stakeholder interests.

Experts:

Jakub Urbanowicz, partner, attorney-at-law at SK&S law firm

Partner in the Litigation and Arbitration Department at SK&S. His legal work is characterized by a strong focus on court and arbitration proceedings, representing diverse clients, including major international corporations, in complex and multijurisdictional high-value legal disputes valued up to PLN 2 billion. His areas of practice encompass a broad range of disputes, including corporate and post-M&A cases, restructuring/bankruptcy, but also personal rights protection.

He is experienced in managing cases at all court levels, including the Supreme Court, and has a solid history of successful cassation appeals. His expertise in arbitration is extensive, with a track record of domestic and international arbitration under the SA KIG, SA Lewiatan, ICC, SIA, and SCC arbitration rules, with places of arbitration in Warsaw, London, Geneva, and Stockholm.

In 2019, he supplemented his experience with an internship at the renowned Hanotiau & van den Berg arbitration law firm in Brussels and has since shared his knowledge and experience through a teaching tenure at SWPS University, plus a number of speaking engagements.

He is recognized for his legal expertise as well as for an approachable, client-focused manner. Clients commend him for his thorough understanding of legal processes and ability to address their needs effectively thanks to this combination of business orientation and personal accessibility. His professional excellence has been recognized in the Expert Guides Rising Stars for commercial arbitration – one of only two in Poland – and in the Legal 500 for dispute resolution.

Marcin Obłoza, senior counsel, attorney-at-law at SK&S law firm

He mainly deals with commercial and civil law disputes in his practice. He represents clients in litigation and arbitration.

His area of specialisation covers a wide range of cases. A significant part of his scope of practice is corporate disputes, which he has been dealing with for more than ten years. He has advised on multifaceted corporate disputes in public companies, other corporations, or partnerships. He has acted as an attorney, among other things, in court proceedings concerning challenges to resolutions of bodies of capital companies, as well as other proceedings related to a corporate dispute that has arisen in a company. He represented both companies, shareholders or partners and members of bodies. He has also advised on the preparation of multi-faceted strategies for handling such disputes at all stages of the dispute that has arisen.

His experience also includes handling other commercial matters, including the enforcement of claims under commercial contracts, as well as advising and representing clients in restructuring and bankruptcy proceedings.
