 Although the Real Estate Tax Act in Poland is not very long or complicated, in practice it raises many issues both for taxpayers and tax authorities. The main reason for this is the numerous references to other legal acts, which reflect various government policies that are not explicitly related to taxation. The most problematic are the definitions of buildings and structures, which refer to the Construction Law and are critical for the correct determination of the real estate tax. As a result, real estate tax cases account for approximately 20% of disputes with tax authorities before administrative courts in 2022. Consequently, taxpayers must consider many decisions of administrative courts to correctly calculate real estate tax. Recently, the Polish Constitutional Court issued a landmark decision calling on the Polish Parliament to adopt the definition of a structure that could simplify the determination of real estate tax.

  • Dr Tomasz Grabka, senior associate, tax adviser at SK&S law firm: Specialises in tax law, in particular, the taxation of financial institutions and financial transactions, as well as in implementing internal procedures to monitor tax and business risks in a changing regulatory environment. Participated in numerous international and domestic restructuring projects and represented clients in disputes with tax authorities, including cases related to VAT carousel frauds. A member of the National Chamber of Tax Advisors. Teaches tax law at Kozminski University. Earlier, he gained professional experience in one of the “Big Four” and an international financial institution.
